Public Statement by the Republican Legislative District 32 Chair on the

December 5th , 2023, Meeting for Representative Horman

The Legislative District 32 Republicans (LD 32) believe questioning a representative of the people is a serious matter. We also believe that it is important to promote true and helpful communication, as may be needed from time to time, between political parties and those who use the party name to get elected.

State law created the role Precinct Committeeman with area lines drawn for neighborhoods across the state. Registered Republican voters elect a partisan individual to represent their voices in party business. This commitment of volunteers is the communication link between the LD 32 and the precinct's voters.

The Precinct Committee Officers have worked to establish and ensure that complaints against any elected representative are provided with fair hearing and due process. Upon receiving complaints, your Precinct Officers created a Special Investigative Committee to review the merits, and establish clear rules, conduct and constraints for the scope of the inquiry. We wanted to listen and engage with Representative Horman allowing her opportunity to convey her perspective, state her beliefs, and outline her thoughts relative to each vote. Unfortunately, Representative Horman refused to appear, allowing this process of cooperation and growth.

Representative Horman pledged in writing to "read and support the Idaho Republican Platform and accept it as the standard by which my performance as an officeholder should be evaluated."

A review was conducted over several months. Representative Horman was invited multiple times by multiple individuals to communicate with the committee, in person and in writing, for the purpose of helping us understand her approach and thoughts regarding the votes in question and for her to understand our concerns.

In the original complaints, there were seven alleged violations which the Special Investigating Committee subsequently recommended reduction to four allegations. These four allegations were accepted by the governing body of the LD 32 as the subject of the December 5th meeting.

As a result of the established due process, the LD 32 Committee diligently deliberated each of the four allegations, ultimately reducing the number to zero violations the Idaho Republican Party Platform.

Our State Republican Party Platform is a dynamic document responding to the concerns and the vision that Idahoans must innovate better ways of how We the People govern ourselves. Our platform helps our party work together to promote freedom, responsibility, and a just process. The platform promotes fairness in dealings with all elected representatives as well as giving direction for what we as a party value and promote.

At each step, our Precinct Committee Officers have been admirable in a process marked by decorum and with opportunity to increase communication, and I sincerely appreciate the spirit in which they have conducted themselves on this journey.

Throughout this hearing process, our goal has been to open lines of communication between Representative Horman and the Republican Legislative District 32 Committee. Our goal is to work together with all our elected representatives.

A Resolution of Guidance for Representative Wendy Horman

WHEREAS, Wendy Horman was elected as a Republican representative of the State of Idaho House of Representatives in Legislative District 32;

WHEREAS, Representative Wendy Horman did pledge to support the U.S. Constitution, Idaho State Constitution and the Republican Party Platform during her run for office and her tenure in office;

WHEREAS, a Petition was delivered to the LD32 Chairman with respect to Representative

Wendy Horman's possible breach of her Article Xlll Integrity in Affiliation pledge containing 7 Allegations;

WHEREAS, LD32, at a meeting held on October 19, 2023, formed a Special Investigative Committee to review the Allegations and render Findings and Recommendations to the LD32 Committee;

WHEREAS, Representative Wendy Horman submitted written responses to the 7 Allegations; NOW, THERFORE, BE IT RESOLVED, that:

  1. The Legislative District 32 Republican Committee wishes to thank Representative

Horman for the written responses/explanations that she provided to the committee.

  1. The Legislative District 32 Republican Committee also encourages Representative Horman to engage the Republican Party and preliminary committees before arguing about the process in public media. We acknowledge that both party and elected officials are learning how to navigate this new process to handle complaints by the party membership. The process requires the committee to give fair consideration not only to legislators, but also those making claims, with the Republican Party Platform as the judge of the actions.

  2. The Legislative District 32 Republican Committee Secretary be directed to transmit an official copy of this Resolution to Representative Wendy Horman.

  3. The Legislative District 32 Republican Committee Chair be directed to transmit a copy of this resolution to the Idaho State Republican party as required by party rules; and

  4. The Legislative District 32 Republican Committee publish a copy of this Resolution on the Bonneville County Republican Central Committee web site.

WHEREAS, Kevin Cook was elected as a Republican senator of the State of Idaho Senate in Legislative District 32;

WHEREAS, Senator Kevin Cook did pledge to support the U.S. Constitution, Idaho State

Constitution and the Republican Party Platform during his run for office and his tenure in office;

WHEREAS, a Petition was delivered to the LD32 Chairman with respect to Senator Cook's possible breach of his Article Xlll Integrity in Affiliation pledge containing 10 Allegations;

WHEREAS, LD32, at a meeting held on October 19, 2023, formed a Special Investigative Committee to review the Allegations and render Findings and Recommendations to the LD32

WHEREAS, Senator Kevin Cook provided no responses to the Allegations;

WHEREAS, the Special Investigative Committee held a meeting on November 27, 2023 that Senator Kevin Cook refused to attend;

WHEREAS, the Special Investigative Committee thereupon rendered Findings and Recommendations to the LD32 Committee on December 4, 2023;

WHEREAS, the LD32 Committee held a hearing on December 5, 2023 where the 10

Allegations and the Special Investigative Committee's Findings and Recommendations were presented and reviewed;

WHEREAS, Senator Kevin Cook did not attend the December 5, 2023 hearing;

WHEREAS, the LD 32 Committee voted and found Senator Kevin Cook to be in violation of the Republican Party Platform on these 4 Allegations:

Allegation 1, Senator Kevin Cook voted "YES" on HB 24; Amendment SBI 167 — "Idaho Launch Grant" in violation of Article I, Section 1 Paragraphs A, D and E and Article l, Section 2, Paragraph C of the Republican Party Platform.

Allegation 4, Senator Kevin Cook voted "NO" on SB1038 — "Freedom in Education Savings Accounts (FIE)" in violation of Article I, Section 1 Paragraphs A, D and E and Article l, Section 2, Paragraph C of the Republican Party Platform.

Allegation 5, Senator Kevin Cook voted "YES" on SBI 147 — "Appropriation of Funds to Program" in violation of Article l, Section 1 Paragraphs A and D; Article Ill, Section 8 and Article XIV, Section 3 of the Republican Party Platform.

Allegation 6, Senator Kevin Cook voted "YES" on SBI 176 — "Appropriation for Colleges and Universities" in violation of Article l, Section 1 Paragraphs A and D and Article Ill Section 8 of the Republican Party Platform

NOW, THERFORE, BE IT RESOLVED, that:

1 The LD32 Committee would like to thank Senator Cook for visiting the public library and changing his position on HB314.

  1. The LD32 Committee would like to remind Senator Kevin Cook that the Republican Party Platform stands strongly against abortion, Critical Race Theory and transgender-based medicine and that NO taxpayer funds should be used in furtherance of those items;

  2. The LD32 Committee would like to express their concern with respect to the sustainability of the Idaho Legislature's spending and remind Senator Kevin Cook that the Republican Party Platform stands strongly against growing government and growing the government workforce;

  3. The LD32 Committee would like to request that Senator Kevin Cook consider the legality of Idaho's association in VWvlAMl with the other State Universities that are potentially violating Idaho Code 18-8705 and Idaho's laws regarding critical race theory and transgender-based medicine;

  4. The LD32 Committee would like to remind Senator Kevin Cook that Article Ill, Section 8 of the Republican Party Platform creates an affirmative duty whereby a Republican elected official should work to support financial measures that PROHIBIT universities, colleges or public schools from including social indoctrination theories into their policies, curriculum and/or course materials;

  5. The Legislative District 32 Republican Committee calls upon Senator Kevin Cook to publicly reaffirm his commitment to the Idaho Republican Party Platform and to consider the Platform when evaluating proposed legislation;

  6. The Legislative District 32 Republican Committee Secretary be directed to transmit an official copy of this Resolution to Senator Kevin Cook;

  7. The Legislative District 32 Republican Committee Chair be directed to transmit a

copy of this resolution to the Idaho State Republican party as required by party rules; and

  1. The Legislative District 32 Republican Committee publish a copy of this Resolution on the Bonneville County Republican Central Committee web site.

WHEREAS, Representative Stephanie Mickelsen did pledge to support the U.S. Constitution, Idaho State Constitution and the Republican Party Platform during her run for office and her tenure in office;

WHEREAS, a Petition was delivered to the LD32 Chairman with respect to Representative Stephanie Mickelsen's possible breach of her Article XIII Integrity in Affiliation pledge containing 16 Allegations;

WHEREAS, LD32, at a meeting held on October 19, 2023, formed a Special Investigative Committee to review the Allegations and render Findings and Recommendations to the LD32 Committee;

WHEREAS, Representative Stephanie Mickelsen provided no responses to the Allegations;

WHEREAS, the Special Investigative Committee held a meeting on November 27, 2023 that Representative Stephanie Mickelsen refused to attend;

WHEREAS, the Special Investigative Committee thereupon rendered Findings and Recommendations to the LD32 Committee on December 4, 2023;

WHEREAS, the LD 32 Committee voted and found Representative Stephanie Mickelsen to be in violation of the Republican Party Platform on these 8 Allegations:

Government Paying Membership Fees or Dues with Public Funds" in violation of Article l, Section 1 Paragraphs A, D and E; Article l, Section 2, Paragraphs A, B and C; and Article l, Section 3, Paragraph B of the Republican Party Platform adopted July 16, 2022.

Allegation 4, Representative Stephanie Mickelsen voted "NO" on House Bill 155 — "Prohibition of the State from Requiring Proof of Certain Vaccinations" in violation of Article Ill, Section 10 and Xlll, Section 3, Paragraphs C and D of the Republican Party Platform adopted July 16, 2022.

Allegation 6, Representative Stephanie Mickelsen voted "NO" on HB 265 — "Restricts Access of Minors to Sexual Exhibitions" in violation Article XIV, Section 4 of the Republican Party Platform, adopted July 16, 2022.

Allegation 7, Representative Stephanie Mickelsen voted "NO" on HB 273 — "Property Tax Amendment" in violation of Article 1 Section 2 Paragraphs A, B and C of the Republican Party Platform, adopted July 16, 2022.

Allegation 10, Representative Stephanie Mickelsen voted "NO" on the override of Governor

Brad Little's veto of HB314 — "The children's School and Library Protection Act" in violation of Article XIV, Section 4 of the Republican Party Platform adopted July 16, 2022. The override failed by one vote in the House of Representatives.

Allegation 12, Representative Stephanie Mickelsen voted "YES on SBI 147 — "Appropriation of Funds to VWvlAMl Program" in violation of Article l, Section 1 Paragraphs A and D; Article Ill,

Section 8 and Article XIV, Section 3 of the Republican Party Platform adopted July 16, 2022.

Allegation 13, Representative Stephanie Mickelsen voted "YES on SBI 176 — "Appropriation for Colleges and Universities" in violation of Article I, Section 1 Paragraphs A and D and Article Ill, Section 8 of the Republican Party Platform adopted July 16, 2022.

NOW, THERFORE, BE IT RESOLVED that:

1 In light of the above violations and the totality of Representative Stephanie Mickelsen's voting record as set forth in Allegations 1 thru 13 in the Petition which demonstrates a gravitation toward the Democrat Party and REPEATED disaffiliation with the Republican Party Platform and Republican Party elected officials, Representative Stephanie Mickelsen be Censured with a Vote of No Confidence in her asserted affiliation with the Republican Party and the Republican Party Platform;

  1. The Legislative District 32 Republican Committee calls upon Representative Stephanie Mickelsen to publicly reaffirm her commitment to the Idaho Republican Party Platform and to consider the Platform when evaluating proposed legislation;

  2. The Legislative District 32 Republican Committee Secretary be directed to transmit an official copy of this Resolution to Representative Stephanie Mickelsen;

  3. The Legislative District 32 Republican Committee Chair be directed to transmit a copy of this resolution to the Idaho State Republican party as required by party rules; and

  4. The Legislative District 32 Republican Committee publish a copy of this Resolution on the Bonneville County Republican Central Committee web site.

Representative Mickelsen's voting record appears to be drawn toward the Democrat party and away from mainstream Republican votes as evidenced by constituent complaints on 13 different bills. While Republicans do deviate from time to time, Representative Mickelsen appears to have a higher frequency of deviancy from Republican values.

Examples of voting against the majority of Republicans and with full Democrat opposition include: HB-155 Prohibition of the state from Requiring Proof of Certain vaccinations, HB-259 No absentee ballots shall be sent out without the request from the voter, HB-265 Restrictions on minors access to sexual exhibitions (drag shows), HB-273 Property Tax Amendment to clarify voters can use initiatives or referendums to reduce the property tax base budget of a city or county, and HB-314 The children's school and Library Protection Act.

In addition to her voting record, Representative Mickelsen seems to have no interest in the Party's concerns over her voting record. Republican Legislative District 32 has tried to communicate with Representative Mickelsen on several occasions without success.

The Republican Legislative District 32 hereby espouses a vote of No Confidence in

Representative Mickelsen by majority vote by duly elected members of the Republican Party in District 32.
